If we're in the process of applying for NHR 1.0 (but haven't finalized yet), can we jump over to 2.0? Or can we finish formulating 1.0 but later transition to 2.0?

This depends heavily on personal circumstances and a 1 to 1 meeting is advisable. However, if you are currently in the process of acquiring the existing NHR tax regime status, it may be advisable to go with that option as the NHR 2.0 is still in the early stages and the upcoming Portuguese budget may affect its overall viability. Also, you cannot have both tax regimes at the same time or have been a previous tax resident under one and then switching to the other.

What date will the govt announce the new budget with details of NHR 2.0?

The new budget is expected to be announced on the 15th of October.

Are there any restrictions or special considerations when buying property in Portugal as a foreigner?

Generally, there are no restrictions for foreigners buying property in Portugal. This makes it a popular choice for investors and those seeking a second home. However, there are a few key considerations:  

1. Fiscal Number (NIF):

  • You'll need to obtain a Fiscal Number (NIF) from the Portuguese tax authority. This is a unique identification number required for various financial transactions, including property purchases.  

2. Currency Exchange:

  • Be aware of currency exchange rates and potential fees when transferring funds to Portugal. It's advisable to consult with a financial advisor to understand the best practices.

3. Property Tax:

  • Portugal has property taxes, including a municipal property tax (IMI) and a stamp duty tax (IMT). These taxes can vary depending on the property's location and value.  

4. Residency Requirements:

  • If you plan to live in Portugal, you'll need to obtain a residency permit. This can be done through various visa programs, such as the D7 visa (for passive income) or the Golden Visa (for investment).  

5. Property Management:

  • Consider hiring a property management company if you're investing in a rental property. They can handle tasks like tenant screening, rent collection, and property maintenance.  

6. Legal Advice:

  • It's highly recommended to consult with a local real estate agent and a lawyer specializing in Portuguese property law. They can guide you through the process, ensure you understand your rights and obligations, and help you navigate any potential challenges.
